TUTELA DEI DISEGNI E DEI MODELLI INDUSTRIALI: IL “PACCHETTO” NORMATIVO IN GUUE

Il 18 novembre 2024, due provvedimenti normativi (“Direttiva” e “Regolamento”) in materia di tutela dei disegni e modelli industriali sono stati pubblicati nella Gazzetta ufficiale dell'Unione europea (GUUE) (1). Si tratta, nello specifico, di quanto segue:
- Direttiva sulla tutela legale dei disegni e modelli;
- Regolamento in materia di disegni e modelli comunitari (“Community designs”).
I testi sono stati precedentemente adottati dal Parlamento europeo (PE) e dal Consiglio dell'Unione (UE).
Quanto alle azioni future riguardanti il “pacchetto” normativo:
- la Direttiva (che abroga la precedente Direttiva 98/71/CE a partire dal 9 dicembre 2027) entrerà in vigore dopo venti giorni dalla pubblicazione in GUUE. Alcuni articoli, tuttavia, si applicheranno a decorrere dal 9 dicembre 2027;
- il Regolamento in materia di “Community designs” (che abroga il precedente Regolamento CE 2246/2002 a partire dal 1° maggio 2025) entrerà in vigore dopo venti giorni dalla pubblicazione in GUUE e diventerà applicabile a partire dal 1° maggio 2025. Alcune parti specifiche del Regolamento (ad esempio, l’art. 1), tuttavia, si applicheranno a decorrere dal 1° luglio 2026.
