Il 5 maggio scorso, la Commissione europea (Directorate-General for Internal Market, Industry, Entrepreneurship and SMEs) ha pubblicato nella Gazzetta Ufficiale (GUUE L120/2023) alcuni emendamenti agli standard tecnici (ITS) in materia di reporting e disclosure, a modifica della legislazione in vigore in ambito Solvency II (Direttiva 2009/138/CE)(1).
In particolare:
- il Regolamento esecutivo (EU Implementing Regulation) 2023/894, del 4 aprile 2023 (ITS on reporting), stabilisce norme tecniche di attuazione per l'applicazione della Direttiva 2009/138/CE (Solvency II) del Parlamento europeo e del Consiglio, per quanto riguarda i modelli da presentare - da parte delle imprese (ri-)assicuratrici - alle Autorità di controllo, in riferimento alle informazioni necessarie alla vigilanza (abroga il Regolamento esecutivo 2015/2450).
Le nuove norme entreranno in vigore il giorno successivo alla data di pubblicazione in Gazzetta e verranno applicate a partire dal 31 dicembre 2023;
- il Regolamento esecutivo (EU Implementing Regulation) 2023/895 del 4 aprile 2023 (ITS on disclosure), reca le norme tecniche di attuazione per l'applicazione della Direttiva 2009/138/CE (Solvency II) del Parlamento europeo e del Consiglio, per quanto riguarda le procedure, i formati e i modelli per l'informativa che deve essere resa dalle imprese (ri-)assicuratrici in relazione ai loro report su solvibilità e condizione finanziaria (abroga il Regolamento esecutivo 2015/2452).
Le nuove norme entreranno in vigore 20 giorni dopo la data di pubblicazione in Gazzetta e verranno applicate a partire dal 31 dicembre 2023.
