Alla fine di maggio, ESMA ha pubblicato un documento (“Supervisory Briefing”) finalizzato a favorire la convergenza della vigilanza sui fondi di investimento aventi caratteristiche di sostenibilità. Il documento stabilisce criteri di vigilanza comuni per le Autorità nazionali competenti (NCA), in modo che gli “investment funds with sustainability features” vengano efficacemente vigilati. Intende contribuire, inoltre, al contrasto del fenomeno del greenwashing.
Il “Supervisory Briefing” – la pubblicazione del quale risulta essere parte delle azioni per la realizzazione della Sustainable Finance Roadmap di ESMA – riguarda le seguenti aree:
- linee guida per la vigilanza in merito a documenti/materiale di marketing relativi ai fondi, nonché principi di riferimento sull'uso della terminologia correlata alla sostenibilità nella denominazione dei fondi;
- linee guida per una vigilanza convergente sull'integrazione dei rischi di sostenibilità da parte di gestori di AIFM/OICVM.
Il documento è strutturato come segue:

- Introduction and background;
- Guidance for the supervision of fund documentation and marketing material
Verification of the compliance of the pre-contractual disclosures
Verification of the consistency of information in the fund documentation and marketing material
Verification of the compliance with the website disclosures’ obligations
Verification of the compliance with the periodic disclosures’ obligations
Additional supervisory actions - Integration of sustainability risks by AIFMs and UCITS managers;
- Regulatory interventions in case of breaches.
